General Terms and Conditions for Ticket Buyers

Preamble

By purchasing a ticket in the ticket shop provided on this page by the festival organizer - hereinafter referred to as 'Zytanien' - the ticket buyer - hereinafter referred to as 'TB' - accepts the following general terms and conditions for ticket buyers.

§1 Contracting parties

1.1 With the purchase of one or more tickets in the ticket shop operated by Zytanien, a purchase contract is concluded between the TB and Zytanien.
1.2 All offers in the ticket shop are directed exclusively at natural persons of full age within the meaning of §13 BGB (German Civil Code).

§2 Subject matter of the contract and conclusion of the contract, withdrawal from the contract on the part of Zytanien

2.1 The offer for a contract starts from the TB, as soon as he has submitted his order by clicking the [CHECKOUT] button in the ticket shop. With the receipt of the order confirmation by e-mail, a contract between the TB and Zytanien comes into being.
2.2 Zytanien is entitled to cancel the order of the TB, if the TB does not comply with the terms of payment specified in the order process and under §4, or tries to circumvent or delay them. Partial payments for tickets ordered will not be accepted by Zytanien and will not be refunded. Zytanien will send no send payment reminders in case of partial payments or if payments are not received or not received within the requested period.
2.3 Transfers that contain no or an incorrect purpose make a clear assignment of the payment to an order impossile and will be handled as described in §2 Par. 2.2.

§3 Right of revocation for ticket buyers

3.1 The festival tickets offered in the ticket shop are access authorisations for a leisure event within the meaning of § 312b Par. 3 No. 6 BGB. This means that the statutory right of withdrawal or return for end customers, which is otherwise customary in distance selling, does not apply for ticket orders in the Zytanien ticket shop. The purchase becomes binding immediately after Zytanien has confirmed the order, and the TB undertakes to accept and pay in full for all tickets purchased by him.

§4 Payment, ticket shipping and secure storage

4.1 Before purchasing a ticket, the TB must ensure that his account is sufficiently covered.
4.2 The total amount shown in the order confirmation is due for payment immediately upon receipt of the order confirmation.
4.3 For payments received later than 3 days after dispatch of the order confirmation, Zytanien reserves the right to cancel the order according to §2.
4.4 If payment is received in full and on time, Zytanien will send the tickets ordered as a printable PDF file by e-mail immediately and without further notice to the address indicated by the TB.
4.5 The TB must ensure that the e-mail account specified by him at the time of ordering is working reliably and that at least 150 kB free storage space per ticket is available for saving.
4.6 In addition to the incoming mail folder, the TB is also required to check the so-called spam folder for incoming mail from Zytanien.
4.7 The TB must ensure that third parties do not have access to the PDF files sent and cannot make copies of tickets that have already been printed out.

§5 Loss and reclamation

5.1 The TB is held to check the incoming ticket PDF file(s) for readability immediately upon receipt and print it on a white A4 sheet in portrait format.
5.2 Orders with the status "Payment received" also contain a clickable "Ticket Download Link", via which the TB can access the tickets ordered online again if the ticket e-mails mentioned in 4.4 have been accidentally deleted.
5.3 In the event of further questions or technical problems, the TB may contact Zytanien by e-mail via tickets@zytanien.de at any time, but not later than 3 days after completion of the pre-selling. In addition to the problem description, this e-mail must contain the following information: First Name and Last Name, and if an order/payment has already been initiated, Ticket No. and the date of the transfer.
5.4 Ticket holders who did not buy their ticket in the Zytanien ticket shop will not receive any direct help from Zytanien, but must contact the previous owner from whom they bought the ticket or received it as a gift in the event of problems.

§6 Entrance requirements and ticket validation

6.1 Prerequisite for access to the Zytanien Festival area is the presentation of the ticket sent by the ticket shop by e-mail in printed form on a white A4 sheet of paper in portrait format. The QR code on the ticket will be scanned at the entrance control and checked for validity. The sole presentation of an account statement, an order confirmation or an invoice will not be accepted by Zytanien.
6.2 In case of a successful validation, the exact person who presented the ticket first will be granted access to the site.
6.3 On admission, the ticket will be retained by Zytanien, exchanged for a wristband, and the ticket number will be invalidated in the database of the ticket shop. Deliberately as well as accidentally distributed ticket duplicates lose their validity this way.
6.4 Visitors who present duplicate tickets or counterfeit tickets will not be admitted to the festival. Zytanien also reserves the right to record the personal data of the person concerned and to file a complaint for attempted fraud.
6.5 Visitors with a resident's ticket must present their identity card upon entry to confirm their residence in Immensen or Arpke.

§7 Data privacy

7.1 For all orders processed in the Zytanien ticket shop and the resulting follow-up processes, applies the data protection declaration available at https://www.zytanien.de/en/datenschutz.
7.2 The TB confirms that he has read, understood and accepted these data protection declaration before the ticket purchase.

§8 Final clauses

8.1 For all orders processed in the ticket shop only these general terms and conditions apply to the contract between Zytanien and the TB.
8.2 Should individual provisions of these these general terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions.
8.3 The law of the Federal Republic of Germany shall apply exclusively without consideration of private international law and/or the UN sales law adopted into German law.
8.4 Place of jurisdiction and performance is Lehrte.
